This section covers the general information on biddings, selection of vendors, goods, work contractors and service providers for RusChemAlliance business needs.
All the biddings in the company are carried out in accordance with the requirements of Regulations on Bidding of Goods, Works, Services. The requirements of Federal Law No. 223-FZ "On Bidding of Goods, Works and Services by Certain Types of Legal Entities" shall not apply to RusChemAlliance while bidding and purchase processes.
Competitive bidding, carried out as a competitive procedure, by no means is neither a bidding by auction (including is not a competition, auction) in accordance with Articles 447–449 of the Russian Civil Code, nor a public competition in accordance with Articles 1057-1061 of the Russian Civil Code or other similar procedure. At the same time, any direct or indirect reference during the bidding to biddings by auctions, competitions and (or) auctions shall not be construed as entailing or enabling application of the above-mentioned provisions of the Russian Civil Code, or otherwise bind RusChemAlliance to enter into any contract (transaction), pay remuneration, reimburse the losses and/or penalties, as well as make other respective actions.
RusChemAlliance is entitled to refuse from bidding before time (before the end of bidding), as well as accomplish the bidding without entering into contract based on the results of bidding at any time before the conclusion of the contract based on the results of bidding. By so doing the company shall not inform the bidders about the reasons for rejection (cancellation) of the bidding (entering into contract). The company does not reimburse the costs incurred by the bidders due to participation in bidding and (or) any losses (penalties).
Any RusChemAlliance advertisements, including on bidding, announcements, notifications, bidding documentation, communication of information on bidding in another forms, is in no case a public offer to the extent of Article 437 of the Russian Civil Code.
